Whenever a governmental entity such as medicare, the veterans administration, one of military service or AHCCCS pays for the medical treatment of an injured person, that entity will have a lien against the recovery from the person at fault. When a workmen’s compensation carrier pays for the medical treatment of an employee, the carrier will also have a lien against the recovery. Finally, some medical insurers also assert a lien for the payments they made for their own insured, to recover the monies they paid to the doctors or hospital. These latter liens are limited to medical insurance plans funded by ERISA plans.
